Description of Services
Clark-Ritchotte Communications provides IT infrastructure, voice and telecommunications, managed WordPress hosting, creative services, and related digital business services as described on this website or in an individual service agreement or quote.
Use of Services
You agree to use our services only for lawful purposes and in accordance with our Acceptable Use Policy. You are responsible for maintaining the confidentiality of any account credentials issued to you and for all activity under your account.
Payment & Billing
Fees for services are outlined in your quote, order form, or service agreement. Unless otherwise stated, invoices are due upon receipt, and continued non-payment may result in suspension or termination of services.
Intellectual Property
Deliverables created specifically for you under a signed agreement are assigned or licensed to you as specified in that agreement upon full payment. Our underlying tools, methodologies, and pre-existing materials remain our property.
Service Availability
We work to maintain reliable uptime for hosted and managed services but do not guarantee uninterrupted availability. Scheduled maintenance will be communicated in advance where practical.
Limitation of Liability
To the maximum extent permitted by law, Clark-Ritchotte Communications is not liable for indirect, incidental, or consequential damages arising from use of our services. Our total liability for any claim is limited to the fees paid for the service giving rise to the claim.
Termination
Either party may terminate services in accordance with the terms of the applicable service agreement. We reserve the right to suspend or terminate services for violation of these Terms or our Acceptable Use Policy.
Governing Law
These Terms are governed by the laws of the State of New York, without regard to conflict of law principles.
Changes to These Terms
We may update these Terms from time to time. Continued use of our services after changes take effect constitutes acceptance of the revised Terms.
